The internet site www.clickbus.com.mx and CLICKBUS application for mobile devices, hereinafter collectively referred to as “Platform,” are owned and operated by CLICKBUS SERVICIOS S.A.S., hereafter CLICKBUS, whose registered office is at Av. Álvaro Obregón 151, Piso 12, Col. Roma Norte, C.P. 06700, Cuauhtémoc, Mexico City., 01 800 681 1604, and e-mail:  soporte@clickbus.com.mx

 

Anyone who browses uses or registers to this Platform is considered a “USER.” By using the services provided by the company CLICKBUS, you are confirming that you have read, understood and agreed to these Terms. If you do not agree with these terms and conditions, you are advised not to continue browsing or using this website.  ClickBus reserves the right to change or modify, at its sole discretion, the Terms without prior notice. Your continued access or use of the Website means that you accept the updated or modified Terms.

 

CLICKBUS is not a transport company, nor acts as a commercial agent or representative of any transport company. ClickBus provides an online platform through which legally established carriers that operate road passenger transport services, hereinafter “Transport Companies,” may offer their services to Users. In this way, the Platform acts as an interface that links the Intercity Transport Companies and the Users and helps them establish a contractual relationship, where the carriers announce its services and passengers reserve and purchase their tickets.

 

FIRST - USER: The User, natural or legal entity, acting under his own name or by his legal representative, acknowledges having the legal capacity to contract and bear the obligations. Moreover, he or she states that there are no legal impediments that prohibit the user to be bound by this contract.

 

FIRST PARAGRAPH: All customers under 18 years of age can only sign up for the services offered on our website with the consent of their parents or legal representatives. Those shall be liable for any lawful or unlawful act practiced by their children while using the Platform.

 

Children aged under 12 years are not allowed to travel unaccompanied and must be accompanied by one parent or legal guardian. Carrying evidence of this relationship is mandatory.  If there is no degree of kinship between the child and his or her companion, the carrier will request a written authorization allowing the child to travel via this mode of transportation. This document must be signed by the father, mother or legal guardian of the child. The signature must be notarized. Parents who hold a special need that their children under 12 years of age travel alone may request a special authorization to the family courts.

In this case, the “Customer” under 12 years may travel unaccompanied as long as he or she carries all the documents requested.

ClickBus is a specialized online booking platform for bus travels to Mexico City, Chiapas, Veracruz, Puebla, Cancun and close to 2,000 destinations. It offers convenience for those who travel by the main bus companies in Mexico, namely ADO, AU, Estrella de Oro, Tufesa, Vencedor and other affiliated companies.

Terms and conditions for the use of services offered by ClickBus

 

The following provisions of use represent the “general conditions” of use offered by the company “CLICKBUS SERVICIOS, SOCIEDAD DE RESPONSABILIDAD LIMITADA DE CAPITAL VARIABLE,” registered with the number A201311051052020194, based on Av. Álvaro Obregón 151, Piso 12, Col. Roma Norte, C.P. 06700, Cuauhtémoc, Mexico City.

 

The “Customer” means the person who will purchase the bus tickets to the cities where “CLICKBUS” offers travel routes. The “Customer” acknowledges that “CLICKBUS” is in no way responsible for any service provided by the Intercity Transport Companies after our company delivers you your travel ticket, including damages, baggage losses, travel accidents, route deviations or any other damage related to services not provided directly by “CLICKBUS.”

 

1. TERMS AND CONDITIONS OF USE

 

1.1 By purchasing via CLICKBUS, the client automatically accepts and agrees to our terms and conditions of use outlined in this agreement.  If you object to any provision of these Terms, you shall stop immediately to browse and use our Website.

 

1.2 CLICKBUS does not guarantee that its contents are appropriate or available for use in locations outside the Mexico boundaries. Accessing the Site from territories in which such is illegal or restricted is prohibited. You agree that if you choose to access the Site, from any location outside Mexico, you do so on your own initiative and are solely responsible for compliance with local laws.


 

1.3 By browsing the CLICKBUS website, the customer acknowledges, accepts and agrees that this use is governed by the applicable law of the United Mexican State related to your conduct online and content available.

 

1.4 The information about our services is in Spanish, organized on our site in a concise and clear manner, featuring all the information regarding routes and tickets availability.

 

1.5 The use of our website is private and restricted, and its commercial use by non-authorized third parties is forbidden. It is also prohibited, according to the law, to use any automated system or software to extract data from Our Website, aiming to disclose it anywhere in the world without the consent of its owners.


1.6 “CLICKBUS”  is committed to using reasonable efforts to keep its site available and without interruptions on a 24-hour/7-day-a-week basis, except when it is subject to necessary scheduled downtime for maintenance, unscheduled maintenance, and system outages, including downtimes related to the complex dependency on the telecommunications services provided by third-parties. We cannot promise that access to the Site will be uninterrupted or error-free.  

1.7  “CLICKBUS” does not hold any responsibility for errors or delays when removing any inadequate, illegal or censored provided to us by our vendor or third-party. Our staff may also change, without prior notice and at its sole discretion, the content and functionalities of our website.  

 

1.8  The purchase of our services will be concluded once the payment is processed by the financial entity responsible for charging this fee. “CLICKBUS” does not have any interference in this transaction, which is carried out between the client and the financial entity independently.

 

1.9 CLICKBUS does not guarantee that the services provided by the financial institutions are free of errors, interruptions, malfunctions, delays or any other type of failures. The “Customer” agrees that under no circumstances “CLICKBUS” will  be liable for managing the payment or any situation arising out of or related to your inability to use our services.


 

1.10 “CLICKBUS” reserves the rights to update or change any provision included in this Privacy Policy without further notice. When a new document comes into force, it shall not affect the services established by the previous contract. We recommend that users check back and review this Privacy Policy periodically and carefully before starting to use or perform any operation on our website.  

 

1.11 “CLICKBUS” will take all the necessary measures to ensure the confidentiality, security, and integrity of the information provided by our customers. However, it shall not be liable for damages arising out of security breaches performed by third-parties to disclose the information provided by the customers.   

 

1.12 For this reason and concerned about the security and privacy of the data entrusted to us and stored on our site, the company ensures that all personal data of our customers is protected.

 

1.13 “CLICKBUS” is not responsible for any damage, loss or cost incurred as a result of, or in connection with failures in the system or the Internet caused by third-parties or other instances of force majeure and beyond our control.

 

2. SUBJECT OF THE CONTRACT

 

2.1 The subject matter of the contract is the facility that the company “CLICKBUS” offers to its “CUSTOMER” to purchase intercity bus tickets.

 

3. SERVICES AND CONTENT USAGE RULES


3.1  REGISTRATION OF CUSTOMERS

 

3.1.2 The registration process is not mandatory for customers to purchase their tickets. Unregistered clients may proceed with their booking following the steps indicated on our website.

 

3.2 When the company “CLICKBUS” allows, the “CUSTOMER” may sign-in for the services and enjoy special benefits offered to those who choose registering themselves to our website. The registration will be confirmed after submitting the requested file with your personal information.

 

3.3  The “CUSTOMER” cannot be registered twice. If a duplicate account is created, CLICKBUS reserves the right to verify this data and automatically eliminate any double registration.

 

3.4  Every “CUSTOMER” under 18 years of age must have the consent of their parents or legal guardians before submitting their email or any data requested by the company on our website.  All registration information provided by the “CUSTOMER” must be truthful, accurate, concise and updated.  In the case of any change, the “CUSTOMER” acknowledges that “CLICKBUS” does not have any obligation to verify the data submitted by its “CUSTOMER” or any other person on their behalf.

 

3.5 “CLICKBUS” is not responsible for any incorrect data submitted by the “CUSTOMER.”  The “CUSTOMER’ and their parents or legal guardians are the sole responsible for the accuracy of the data registered.

 

3.6 The company “CLICKBUS” undertakes to protect the personal data of our customers, and, by no mean, the company shall disclose or sell them without previous authorization. On the other hand, the customer acknowledges that the Internet is a global network of computers that allows access to all kinds of people and is not 100% safe. When using our website, CLICKBUS is not responsible for any harm suffered concerning the loss of personal data registered or problems caused by third parties, directly or indirectly, related to the use of our website.


3.7  “CLICKBUS” can modify at its discretion all the requirements and demands to keep our customers registered on the website.

3.8  Every customer has the right to rectify the data sent to CLICKBUS when registering on our website. However, this rectification right does not replace the right that the company "CLICKBUS" has in requesting compensation arising out of, or in any way connected to, the damages caused to the company or third parties by the information entered incorrectly during the period prior to the submission of this rectification request by the user.

 

4. CANCELING THE REGISTRATION OF THE “CUSTOMER”

 

4.1  When “CUSTOMER” register to the “CLICKBUS” services he or she may opt to receive special deals, promotions, and news from the company. The “CUSTOMER” who no longer wishes to be registered to our service must forward an e-mail to soporte@clickbus.com.mx requesting this service cancellation.

 

5. STEPS FOR PURCHASING THE TICKET

 

To purchase your tickets via "CLICKBUS", follow the instructions below:

 

5.1  First step: travel requested data

 

5.1.1 First fill out the spaces referred to the departing point of your trip, the destination and date of travel.

 

5.1.2 After completing and submitting this information, the customer must choose a bus line available on our website according to its schedules and prices shown at the time of purchase.


 

5.2 PURCHASE OF SEATS

 

5.2.1 Every "CUSTOMER" can reserve their seats through our website. However "CLICKBUS" is not responsible for any error made at the time of selecting the seat. In this case, customers acknowledge the importance of being accurate and precise when submitting their personal data.

 

5.2.2 The seats will only be assigned when the ticket is paid. If the payment is not made, the seat will be canceled and become available for booking by another customer.

 

5.2.3 The ticket must have the name of the passenger who will travel, who must present an official photo ID upon boarding.

 

5.3 TICKET PAYMENT

 

5.3.1 The “CUSTOMER” has to fill out all your data correctly to purchase your ticket. This information will be verified by the credit card operator and an anti-fraud protection system.

 

5.3.2 The company is not responsible for any incorrect data, as well as for any payment that has not been processed or approved after being analyzed.


5.4  Payment confirmation

5.4.1 Once the transaction is confirmed, CLICKBUS will send an e-mail confirming the process approval and including the purchase receipt. Check your electronic wastebasket (SPAM) to ensure that your email arrives correctly.

5.5 Pending purchases

 

5.5.1 Depending on the purchase history of your credit card and the person or data inserted to make pay for this booking, this verification process may take longer.

 

5.5.2 Once this process is over; the customer will receive an e-mail confirming the booking with the ticket(s) attached as PDF file(s). Customers have to download and print this electronic ticket to show it before boarding the bus.

 

5.6 Purchases not approved

 

5.6.1 A purchase may be denied by our verification system due to the credit card information details or other decision taken by the credit card operator, of which CLICKBUS is not informed. In these cases, the purchase will be automatically canceled, and the information concerning this transaction will be available under the payment section.

 

5.7 Incomplete purchases

 

5.7.1 If the customer cannot finish the purchasing process, the transaction sum will not be charged, and the seats will not be booked.

 

5.8 Ticket printout

 

5.8.1 Once the purchase is over; the client will receive an e-mail confirming the payment and the electronic tickets purchased. Customers should print their tickets at their own convenience at home or any printing shop. There is no need to exchange the ticket at the company’s counter once arriving at the station, but customers must show the printed PDF before boarding the bus. Some exceptions may occur at those stations and bus lines that accept mobile boarding passes.

 

5.8.2 IMPORTANT: Please note that passengers are not allowed to print their tickets at the bus line sales office or counter at any bus terminal.


5.9  Ticket changes

 

5.9.1 Passengers may request to change the date and time just once. All amendments are made at the ticket office of the bus line until two hours before the departure time.

 

5.9.2 It is not possible to make any change regarding the time and date of your trip via telephone or using the ClickBus website.

 

5.10  Service fee

 

5.10.1 All the purchases made at the www.clickbus.com.mx will be subjected to a service fee of 16% over the total sum.

 

6. PAYMENT METHODS

 

6.1 Credit and debit card

 

6.1.1. “CLICKBUS” accepts the following credit and debit cards: VISA, MASTERCARD, and AMERICAN EXPRESS. “CLICKBUS” will charge the amount to the credit or debit card of the “CUSTOMER” immediately after the “CUSTOMER” accepts the transaction by clicking the option “BUY NOW.”

 

7. PURCHASE APPROVAL



 

7.1 All the transactions made will be reviewed and approved by the responsible company.  In case that it is confirmed, the customer will immediately receive the proof of the ticket purchase.


 

7.2 “CLICKBUS” does not ensure that the services provided by the company responsible for managing the payment will work without errors, interruptions, malfunctions, delays or any other type of defects.


 

7.3 It may take up to eight hours to verify and approve purchases paid by credit card.

 

8. PAYMENT IN INSTALLMENTS

 

8.1 The “Customer” may choose to pay the total amount divided by three up to six monthly installments using your credit card.

 

8.2 The minimum amount required for this transaction is $500.00 Mexican Pesos.

 

8.3 The interested applied for deferring the payment is:

 

8.3.1 The interest for deferring for three months is 20%

 

8.3.2 The interest for deferring for six months is 23%

 

9. PAYMENTS IN FOREIGN CURRENCY

User can select the currency of their choice to make the payment for the ticket (s). The currencies available are Mexican pesos (MXN) and US dollar (USD). This option will be shown in the top bar of the results menu after the customer has clicked the "Search Tickets" button.

 

However, all payments will be made in Mexican pesos. The exchange rate used to convert Mexican pesos into US dollars will be the average selling rate, reached the day before the payment.

The US dollar price shown is based on different public sources to make the conversion and acts as a reference only. The affiliates and/or suppliers of ClickBus do not guarantee the accuracy of the value of the currency. For any financial purpose, the user is advised to consult a qualified professional to verify the accuracy of the exchange rate. The bank issuing the payment could charge additional fees for the collection in a foreign currency.



 

10. TERMS AND CONDITIONS FOR PAYMENTS MADE AT STORES AND BANKS

 

Travelers must read and acknowledge the following conditions when paying for your bus tickets via one of the authorized vendors and banks.

We remind you that the availability of the seats selected is not guaranteed when customers choose to pay for their tickets via stores or banks. The number of seats available may vary from the time the customer books its fare and the moment when he/she concludes the payment.

 

The payment order will be in effect for 15 hours starting from the moment that the client clicks on the button “Buy now”. ClickBus is not responsible for payments made after the deadline established in the payment order.

 

Instructions for payment are generated exclusively by ClickBus or its providers. All payment orders are forwarded via email to the electronic address submitted by the client and must be printed for the payment at the store of their choice. Any other instruction or voucher issued by any other means will not be recognized as valid.

 

Cancellation and transfer of tickets are not possible. In case the selected seat has been occupied, ClickBus will proceed to change the seat number (s) on the same bus. If the bus reaches its maximum capacity, the passenger will be placed on a different bus, running at another time, if there are seats available. In case the client decides not to travel under any of the options offered by ClickBus, the company cannot refund the ticket in any circumstance. ClickBus will return the sum paid as a credit to your registered account on the website. Customers can redeem this balance on their next purchase. This bonus can only be used by: customers who have paid their tickets within the 15-hour limit established by ClickBus; and have the original payment voucher that ascertains the date and time of the deposit. Tickets are non-refundable.  The money paid or collected when using this mean of payment remains as "balance in favor" for future purchases.

 

ClickBus reserves a 24-hour limit to confirm the validity of any payment made in a store, bank or establishment.

 

To make the purchase valid, travelers must pay the exact amount (including cents) and inform the reference number provided.

 

Read carefully the terms and conditions of the store where you will make the payment for your bus tickets and check the store service hours. In case that you need any clarification or report an error in the system, keep your payment receipt.

 

For any clarification, keep your proof of payment.

 

ClickBus is not responsible for payments made after the 15-hour time frame provided by your payment order. We recommend finalizing the purchase as soon as possible.

- OXXO offers a network of 13,000  stores across the country where ClickBus' customers can make their payment.

 

- Travelers must take a printed copy of the order of payment to complete this transaction.  

 

-The maximum amount allowed for payments is $15,000 Mexican Pesos per transaction. Only cash payments are received.

 

-The service hours for payments and deposits are Monday to Sunday from 8:00 am to 8:00 pm. Stores also open on holidays.

 

-A fee of $9 pesos is charged for each transaction made in this establishment.

 

10.2 7-ELEVEN

 

Payments at 7-ELEVEN

 

- 7-ELEVEN offers a network of more than 1,900 stores in Mexico for passengers conveniently process their payment at the establishment of their choice.

 

-Travelers must take a printed copy of the order of payment to complete this transaction.  

 

- The store will process the maximum amount of $5,000 mexican pesos per transaction. Only cash payments are allowed.

 

-The service hours for payments and deposits are Monday to Sunday from 8:00 am to 8:00 pm

 

-A commission of $8 is charged for each transaction made at this establishment.

 

10.3 COPPEL

- You can pay your bus tickets at any of the COPPEL stores in Mexico.

 

- Travelers must take a printed copy of the order of payment and the reference number to complete this transaction.  

 

-The store will process the maximum amount of $15,000 Mexican Pesos per transaction. Only cash payments are allowed.

 

-The service hours for payments and deposits are Monday to Sunday from 8:00 am to 10:00 pm

 

-There is no extra commission per transaction in this establishment.

 

10.4 ELEKTRA

 

Payments at Elektra

 

- You can pay your bus tickets at any of the Elektra stores in Mexico.

 

- Travelers must take a printed copy of the order of payment and the reference number to complete this transaction.  

 

- The store will process the maximum amount of $15,000 Mexican Pesos per transaction. Only cash payments are allowed.

 

-The service hours for payments and deposits are Monday to Sunday from 9:00 am to 9:00 pm

 

-There is no extra commission per transaction in this establishment.

 

10.5 EXTRA

 

Payments at Extra

 

- You can pay your bus tickets at any of the EXTRA stores in Mexico.

 

- Travelers must take a printed copy of the order of payment to complete this transaction.  

 

- The store will process the maximum amount of $5,000 Mexican Pesos per transaction. Only cash payments are allowed.

 

-The service hours for payments and deposits are Monday to Sunday from 1:00 am to 10:00 pm

 

-A commission of $8 is charged for each transaction made at this establishment.

 

10.6 Telecomm

 

Payments at Telecomm

 

- You can pay your bus tickets at any of the 1,608 branches in Mexico.

 

- Travelers must take a printed copy of the order of payment to complete this transaction.  

 

- The store will process the maximum amount of $5,000 Mexican pesos per transaction.

Only cash payments are allowed.

 

-The service hours for payments and deposits are Monday to Sunday from 8:00 am to 8:00 pm.

 

10.7 Farmacias abc

 

Payments at Farmacias abc

 

- You can pay your bus tickets at any of the Farmacias abc branches in Mexico.

 

-Travelers must take a printed copy of the order of payment and the reference number to complete this transaction.  

 

- The store will process the maximum amount of $5,000 mexican pesos per transaction. Only cash payments are allowed.

 

-The service hours for payments and deposits is Monday to Sunday from 8:00 am to 10:00 pm

 

10.8 Farmacias Esquivar

 

Payment in Farmacia Esquivar

 

- You can pay your bus tickets at any of the branches of Pharmacy Esquivar in Mexico.

 

- Travelers must take a printed copy of the order of payment and the reference number to complete this transaction.  

 

- The store will process the maximum amount of $5,000 Mexican Pesos per transaction. Only cash payments are allowed.

 

-The service hours for payments and deposits are Monday to Sunday from 8:00 am to 8:00 pm

 

10.9 Casa Ley

 

Payment at Casa Ley

 

- You can pay your bus tickets at any of the branches of Casa Ley in Mexico.

 

- Travelers must take a printed copy of the order of payment and the reference number to complete this transaction.  

 

- The store will process the maximum amount of $5,000 Mexican Pesos per transaction.

 

Only cash payments are allowed.

The service hours for payments and deposits are Monday to Saturday from 7:00 am to 7:00 pm and Sundays from 7:00 am to 1:00 pm

 

11. LUGGAGE ALLOWANCE

 

11.1 Travelers are entitled to take one piece of baggage free of charge, with the following restrictions:  

 

Weight: limited to 25 kg per person.

Dimension: 300 cubic centimeters Volume:  Width: 1 m

 

Carry-on baggage must weight maximum 5 kg and be flexible to fit into the space available and not affect the comfort and safety of other passengers and the cleaning of the bus.

 

11.2 If a suitcase exceeds the weight limit of the baggage allowance, a fee will be charged per extra kilo. Check the official website of the bus line of which you will travel to learn the exact amount paid for carrying additional luggage.

 

11.3 Articles considered dangerous, according to the legislation in force in Mexico, are prohibited on-board, as well as taking other products which nature may compromise the safety of the vehicle, passengers, and third parties.

 

12. ON INTELLECTUAL PROPERTY

 

12.1 The Customer acknowledges and agrees that the elements that constitute the Website, including without limitation, logos, brands, images, icons, text and other proprietary materials published on its page constitute an intellectual property owned by us, which are protected by copyright laws and/or other intellectual property laws - by applicable national and international legislation. Customers shall abstain to claim the ownership and property rights of these elements.

12.2 It is expressly forbidden for users to copy, reproduce, distribute, modify, display or the creation of derivative works from the content presented or promoted by our website, which is considered property of the company.

 

13. BILLING

 

To receive an invoice for your purchase you must visit the website of the bus company that you chose to travel. Each bus carrier has a section where you can request this invoice to be issued. If you want an invoice for the service fee charged by ClickBus, send your ticket(s) together with your tax information as beneficiar, address and RFC, to the mail: finanzas@clickbus.com.mx and we will gladly send you your invoice. Our mail arrives, preferably, every Friday.

14. OFFICIAL SALE CHANNELS OF CLICKBUS TICKETS

 

The only official ClickBus ticket sales channels are our website (https://www.clickbus.com.mx) and our application, available for IOS and Android systems, that can be downloaded on your mobile phone available. Our customer service number is 01 800 681 1604.

 

IMPORTANT:  Direct sales using social networks, such as Twitter or Facebook constitute a FRAUD. "CLICKBUS" is not responsible for purchases acquired through these means (including other social networks) since these channels are only used as a communication tool to provide information and/or promote special deals to our customers.

 

15. GOVERNING LAW AND FORUM SELECTION

The validity of this Agreement and the rights, obligations, and relations of the parties shall be construed and determined following the legislation of Mexico.

You acknowledge that any action or suit brought to enforce any right or remedy of this Agreement shall be subject to the exclusive jurisdiction and venue of the United Mexican State.

 

16. GENERAL PROVISIONS

 

16.1 When buying a ticket and making the payment through our website, the customer acknowledges and agrees to all the terms and conditions of delivery and the information about the product or service purchased under the aforementioned provisions.

16.2 The company "CLICKBUS" is not responsible for any extra cost that might arise related to the transport.

 

16.3 When clicking on the links to external pages, ClickBus recommends the user to read the Terms of Use and Privacy Policies of each of the pages visited. Our company does not control or represent companies that have a link on our site. As a convenience to our members, ClickBus provides links to many resources and external sites. ClickBus makes no representations as to the quality, suitability, functionality or legality of any sites to which ClickBus may provide links. The User waives any claim the User may have against ClickBus concerning such sites. Any dispute arising from the use of these external links shall be resolved with the owners of those companies without the participation of ClickBus.

 

16.4 Any improper alteration of information or data, infringement of industrial property rights or copyright or violation of the rights of third parties, including children; sending messages that include threats, racist or pornographic content; interference with or disruption of the services provided by our website; or any attempt to spread viruses or unwanted programs will result in the termination of the relationship between the CLICKBUS company and the CUSTOMER.

 

According to the provisions aforementioned, the customer agrees that all the information transmitted, questions answered and including content excluded from the page without prior communication to the customer according to ClickBus decision will be archived for use in case any circumstance arises, without ruling out legal measures, if necessary.
